Does Your Plot Have Road Access?
Nameera (not real names), after doing her stint on TV got some money and contacted a broker who got her a beautiful plot in Nansana with a great view. She bought it immediately.
Very excited she contacted Eng. Abdu (not real names) her cousin’s wife’s cousin to construct her rentals only to find the plot she bought had no road access!
Crest fallen, and feeling ripped off she contacted us to get rid of the plot. We visited the plot and after preliminary findings, we discovered the issue.
If you are in Nameera’s shoes, what are your options?
Summary:
1. Every land owner is entitled to road access to a public highway.
2. The first step to obtain access is through negotiations with the owners of the adjoining land
3. If that fails, application is made to the land tribunal for leave/permission to construct road access through the adjoining land.
4. The application is made through a prescribed form including a sketch map of what access is currently available and what is desired.
N.B: If you can’t get access to the land to make the sketch, apply for leave/permission from the land tribunal for access.
5. A notice is served upon the owner(s) of the adjoining land preferably personally.
6. After 30 days, the land tribunal meets with all parties, hears any objections and grants the access (with or without modifications)
7. The applicant then constructs the road and maintains it.
8. Lastly, this road access must be registered by the registrar of titles – very important. This access is perpetual.
9. The access is not free. The tribunal can request the applicant to compensate the owner of the adjoining land for plants, trees, and other structures such as walls as well as the cost of the land.
10. Caution: Always check for road access before you purchase land! Better be cautious than sorry.
